Motor Carriers of Property

Part 387 Subpart A applies to for-hire motor carriers of property operating motor vehicles in interstate or foreign commerce, and all motor carriers transporting hazardous materials. It does not apply to vehicles under 10,001 lbs., unless hauling certain hazardous materials. One of the following forms must be issued in the exact name of the motor carrier:

MCS-90. For-hire motor carriers in interstate or foreign commerce, who are not self-insured should keep the MCS-90 form, “Endorsement for Motor Carrier Policies of Insurance for Public Liability Under Sections 29 and 30 of The Motor Carrier Act of 1980,” on file. Refer to Figure 1.1: MCS-90 FORM. This form needs to be completed and kept on file (always current) for carriers who are not self-insured. Your insurance carrier should be able to provide you with this form.

MCS-82. For motor carriers of property who are self-insured, the MCS-82 form should be kept on file. It is also called “The Motor Carrier Public Liability Surety Bond Under Sections 29 and 30 of The Motor Carrier Act of 1980”. Refer to Figure 1.2: MCS-82 FORM.  This form needs to be completed and kept on file for carriers who are self-insured.
