100 Air Mile Radius Driver (115 statute miles) §395.1(e)
Driver operates within a 100-air mile radius.
- Driver (except salesperson/ready-mix concrete delivery vehicle) returns to work reporting location and is released from duty within 12 consecutive hours.
- Concrete ready-mix driver returns to work reporting location and is released from duty within 14 consecutive hours.
- Property carrying commercial vehicle driver has at least 10 consecutive hours off duty separating each 12 hours on duty.
- Ready-mix driver has at least 10 consecutive hours off duty separating each 14 hours on duty.
- Passenger carrying commercial vehicle driver has at least 8 consecutive hours off duty separating each 12 hours on duty.
- Maximum driving times for each category of driver is not exceeded
- Property carrying 11 hours
- Ready-mix transport 10 hours
- Passenger carrying 10 hours
Motor carrier utilizing the 100 Air Mile Radius Exception must maintain explicit records determining:
1. Time the driver reports for duty each day (time clock/time-card, etc.)
2. Total number of hours the driver is on duty each day.
3. The time the driver is released from duty each day.
4. Total time for preceding 7 days for intermittent or 1st time drivers. Drivers meeting the above requirements are excepted from ELog requirement {§395.8) and 30-minute rest break provision of {§395.3(a)(3)(ii)|. ELog exception remains in effect so long as the driver does not exceed the 100-air mile radius limitation more than eight (8) times monthly. Upon exceeding the 100-air mile radius the driver must revert to a manual paper grid log for the duty day in question; Documentation of the previous 7-days activity should be available in exempt log or grid log format. (See Weekly Time Sheets, Form 8.1) Special exception for retail store deliveries within a 100-mile radius from December 10 to December 25, both dates inclusive, annually.
