Part 387 Subpart B applies to for-hire motor carriers transporting passengers in interstate or foreign commerce.Exception: The rules in this subpart do not apply to a motor vehicle:
- a)transporting only school children and teachers to or from school.
- b)providing taxicab service and having a seating capacity of less than 7 passengers and not operated on a regular route or between specified points.
- c)carrying less than 16 individuals in a single daily round trip to commute to and from work.
- d)being operated by a motor carrier under contract providing transportation of preprimary, primary, and secondary students for extracurricular trips organized, sponsored, and paid by a school district.
MCS-90B. The MCS-90B form, also called “Endorsement for Motor Carrier Policies of Insurance for Public Liability Under Section 18 of the Bus Regulatory Reform Act of 1982,” should be kept on file by motor carriers transporting passengers when those motor carriers are not self-insured. For an illustration of this form, refer to §387.39.
MCS-82B. This form, also called “Motor Carrier Public Liability Surety Bond Under Section 18 of the Bus Regulatory Reform Act of 1982,” should be kept on file by motor carriers transporting passengers when those motor carriers are self-insured. For an illustration of this form, refer to §387.39.
Regardless of which form you are required to keep on file, the form should show at least the minimum limits shown below. This document must then be kept on file and up-to-date at the motor carrier’s principal place of business.
